1. Introduction & Acceptance
These Terms of Service (“Terms”) govern your use of the website, services, and bookings provided by OQABII Tours and Travel Limited, a company registered in the Republic of Kenya and licensed by the Tourism Regulatory Authority (TRA Registration: TRA1/22/C04/66692).
By accessing our website, making an inquiry, or booking any service with us — including safari packages, flights, hotel reservations, car hire, MICE bookings, or travel consultancy — you acknowledge that you have read, understood, and agree to be bound by these Terms.
2. Services We Provide
OQABII Tours and Travel Limited offers the following services across Kenya, Tanzania, and East Africa:
- Safari planning and travel consultancy
- Hotel reservations and accommodation bookings
- Airfare and ticketing (domestic, regional, and international)
- Visa assistance and travel documentation support
- Travel medical insurance
- MICE bookings (Meetings, Incentives, Conferences, and Exhibitions)
- Car hire and hotel/airport transfers
We act as an intermediary between you and third-party service providers including airlines, hotels, lodges, safari camps, and transport operators. Specific terms of these providers may also apply.
3. Booking Process
3.1 Making a Booking
Bookings can be made via our website contact form, email (reservations@oqabiitoursandtravel.com), WhatsApp (+254 116 183 408), or phone. A booking is considered confirmed only after:
- We issue a written booking confirmation with an itinerary
- The required deposit or full payment has been received
- All necessary travel documentation has been provided
3.2 Booking Accuracy
You are responsible for ensuring all information provided during booking is accurate, including names (as they appear on passports), dates, special requirements, and dietary or medical needs. OQABII Tours is not liable for issues arising from incorrect information provided by the traveler.
4. Pricing & Payments
4.1 Pricing
- All prices are quoted in Kenya Shillings (KES) or US Dollars (USD) unless otherwise stated
- Prices are subject to availability and may change without prior notice until a booking is confirmed
- Published package prices are based on current park fees, accommodation rates, and transport costs — these may be adjusted if suppliers increase their rates before your travel date
- Prices are typically quoted on a per-person-sharing basis unless otherwise specified
4.2 Payment Terms
- Deposit: A non-refundable deposit of 30–50% of the total cost is required to confirm most bookings
- Balance: The remaining balance must be paid at least 30 days before the travel date
- Late Payment: Failure to pay by the due date may result in cancellation of the booking
- Peak Season: During peak travel seasons (July–October, December–February), full payment may be required at the time of booking
4.3 Payment Methods
We accept M-Pesa, bank transfer, and other payment methods as communicated during the booking process. Payment details will be provided in your booking confirmation.
5. Cancellation & Refund Policy
5.1 Cancellation by the Traveler
Cancellations must be communicated in writing (email or WhatsApp). The following charges apply:

| Less than 14 days / No-show | 100% — no refund |
Note: Some services (e.g., non-refundable flights, special event bookings) may have stricter cancellation policies which will be communicated at the time of booking.
5.2 Cancellation by OQABII Tours
We reserve the right to cancel or modify a booking due to unforeseen circumstances including but not limited to: natural disasters, political instability, health emergencies, government travel advisories, or failure to meet minimum group sizes. In such cases, we will offer:
- A full refund of all payments made to OQABII Tours
- An alternative travel date or destination of equivalent value
- Credit towards a future booking
5.3 Amendments
Changes to confirmed bookings (dates, destinations, number of travelers) are subject to availability and may incur additional charges. Amendment requests should be made in writing at least 21 days before departure.
6. Travel Documentation
It is the traveler’s sole responsibility to ensure they possess:
- A valid passport with at least 6 months validity from the date of travel
- Required visas for Kenya, Tanzania, or any transit countries
- Yellow Fever vaccination certificate (required for entry to Kenya and Tanzania)
- Any other health certificates or travel documentation required by immigration authorities
- Adequate travel and medical insurance
While we offer visa assistance as a service, we do not guarantee visa approval. OQABII Tours is not liable for any costs or losses incurred due to missing, invalid, or rejected travel documentation.
7. Travel Insurance
We strongly recommend that all travelers purchase comprehensive travel insurance covering:
- Trip cancellation and interruption
- Medical expenses and emergency evacuation
- Loss or damage to personal belongings
- Personal liability
We can assist in arranging travel medical insurance through our partner providers. Proof of insurance may be requested before departure for certain activities.
8. Health & Safety
- Travelers must disclose any medical conditions, allergies, or physical limitations that may affect their ability to participate in booked activities
- Safari activities involve inherent risks including proximity to wild animals. Travelers must follow the instructions of guides and rangers at all times
- OQABII Tours reserves the right to refuse participation in activities if a traveler's condition poses a safety risk to themselves or others
- We recommend consulting a travel health professional at least 6 weeks before departure for vaccinations and malaria prophylaxis advice
9. Limitation of Liability
OQABII Tours and Travel Limited acts as an agent and intermediary for third-party service providers including airlines, hotels, lodges, transport operators, and activity providers.
- We are not liable for any loss, damage, injury, illness, delay, or inconvenience caused by: acts of God, natural disasters, war, political unrest, strikes, quarantine, government regulations, or the acts/omissions of third-party providers
- Our liability for any claims shall not exceed the total amount paid for the specific service in question
- We are not responsible for personal belongings, valuables, or items left at hotels, vehicles, or other locations
10. Itinerary Changes
While we strive to deliver itineraries as published, we reserve the right to make changes before or during the trip due to:
- Weather conditions or road closures
- Park/reserve regulations or closures
- Accommodation availability (substitution with equivalent or higher category)
- Safety or security considerations
- Flight schedule changes by airlines
We will always endeavor to provide alternatives of equal or better value and communicate changes as promptly as possible.
11. Complaints & Dispute Resolution
If you are dissatisfied with any aspect of our service, please raise the issue immediately with your guide or our office so we can attempt to resolve it during your trip. For post-trip complaints:
- Submit complaints in writing within 14 days of the end of your trip
- Include your booking reference, dates of travel, and a detailed description of the issue
- We will acknowledge receipt within 48 hours and aim to provide a resolution within 30 days
Any disputes that cannot be resolved amicably shall be subject to the laws of the Republic of Kenya and the jurisdiction of the courts in Nairobi.
12. Intellectual Property
All content on the OQABII Tours website — including text, images, logos, graphics, and design — is the property of OQABII Tours and Travel Limited and is protected by copyright laws. You may not reproduce, distribute, or use any content without our prior written permission.
13. Force Majeure
OQABII Tours shall not be held liable for failure to perform any obligation under these Terms if such failure is caused by circumstances beyond our reasonable control, including but not limited to: pandemics, epidemics, natural disasters, government restrictions, airline failures, or civil unrest.
14. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
15. Changes to These Terms
We reserve the right to update or modify these Terms at any time. The “Last updated” date at the top of this page indicates the most recent revision. Continued use of our services after changes constitutes acceptance of the updated Terms.
